Please read the following policies carefully before booking a session.
A non-refundable deposit of 50% of the total session cost is required at the time of booking in order to reserve and lock in your session date, time, and location. Your session is not considered booked or confirmed until this deposit has been received. This deposit exists to reserve that time slot exclusively for you, turning away other potential clients for that date and time, and to compensate for the time, planning, and preparation that goes into every session regardless of outcome.
If you fail to show up for your scheduled session after your deposit has been paid, your deposit is forfeited in full and will not be returned or applied to any future session. The remaining balance of your session cost is due at the time of your session, as outlined below.
If a session is completed as scheduled, the 50% deposit is applied directly toward the total cost of that session; the remaining balance is due at or before the session per the Booking Agreement Notice below. If a client cancels or fails to show up, the deposit is retained in full as compensation for the reserved time and does not carry forward to any rescheduled or future session unless the photographer agrees otherwise in writing.

By booking a photography session with EVERPEAK Visuals, you acknowledge that your booking serves as an agreement between you and the photographer. Reserving a session time means you are committing to arrive at the agreed date, time, and location selected for your session. Failure to show up for your scheduled session may result in the loss of your booking and any payments already made, including your deposit as described above.
Payment is required before final delivery of any photographs. If payment has not been completed, no photos will be released or delivered. The remaining session balance must be paid before or at the start of the session in order to proceed. Accepted payment methods include cash paid at the time of arrival for the scheduled session or card payment through the official online payment link provided specifically for your booked session.
Any additional fees, upgrades, extra services, extended session time, location fees, travel fees, or other agreed-upon charges must also be paid in full before final images are delivered. By booking a session, you confirm that you understand and agree to these payment and attendance requirements.
All photographs, images, and visual content displayed and sold on this website are the exclusive intellectual property of Focal Point Photography and are fully protected under United States and international copyright law, including but not limited to the Copyright Act of 1976 (17 U.S.C. § 101 et seq.) and the Digital Millennium Copyright Act (DMCA). Every image on this website — whether available for purchase, displayed as portfolio work, used in promotional materials, or embedded anywhere on this platform — is legally owned by and belongs solely to Focal Point Photography. These works are protected from the moment of their creation and no license, right, or permission to reproduce, distribute, display, or otherwise use these images is granted unless explicitly stated in writing.

Theft of any photograph from this website — whether through direct download, screenshot, screen capture, right-click saving, or any other method of extraction — constitutes copyright infringement and is a federal offense under United States law. Copyright infringement can result in significant civil and criminal penalties. Under 17 U.S.C. § 504, statutory damages for copyright infringement range from $750 to $30,000 per work infringed, and in cases of willful infringement, damages can reach up to $150,000 per work. Additionally, under criminal copyright law (17 U.S.C. § 506), willful infringement for commercial advantage or financial gain can result in fines and imprisonment. We take the theft of our work extremely seriously and actively monitor the internet for unauthorized use of our images using digital fingerprinting and image recognition technology. Any and all unauthorized uses discovered will be pursued to the fullest extent of the law.
By booking a photography session with Focal Point Photography, you agree to the terms and conditions outlined in this policy. All bookings require commitment from both the client and the photographer, and all purchases, session fees, and payments — including deposits — are considered final once completed.
All sales are final. Once your photography session has been completed, no refunds, exchanges, credits, or reimbursements will be issued for any reason. This includes dissatisfaction with personal preferences, changes of mind, missed expectations, disagreement with the final edited images, or any other circumstances after the session has taken place. By booking a session, you acknowledge and accept the creative style, editing approach, and final delivery process of Focal Point Photography, and you agree that payment made for a completed session — deposit and remaining balance alike — is compensation for the photographer's time, skill, and creative work, and is not contingent on your personal satisfaction with the final images.
Focal Point Photography provides only the final edited images selected and processed for delivery. RAW photos will never be provided, released, or transferred to clients under any circumstances. RAW files are unfinished source materials that do not represent the final artistic work of Focal Point Photography and remain the exclusive property of the photographer.
Clients will receive the completed, professionally edited photographs chosen and finalized by Focal Point Photography. The final delivered images represent the photographer's creative vision, including color grading, retouching, composition adjustments, and other editing decisions made during the post-production process.
